1. GENERAL
These terms and conditions govern your use of Origin Earthworks Ltd. services and website. By engaging our services or accessing this site, you agree to these terms.
2. SERVICES
Origin Earthworks Ltd. provides excavation, grading, drainage, site preparation, land clearing, demolition, and related earthwork services in Calgary and surrounding areas of Alberta. All services are subject to availability and site conditions assessment.
3. ESTIMATES & QUOTES
All estimates provided are valid for 30 days from the date issued. Estimates are based on visible site conditions at the time of assessment. Subsurface conditions, weather delays, or scope changes may affect final pricing. Written change orders are required for any work beyond the original scope.
4. PAYMENT TERMS
Payment terms vary by project size and type. Standard residential projects require payment upon completion. Commercial projects may require a deposit with balance due upon completion or per agreed milestone schedule. All amounts are in Canadian Dollars (CAD) and do not include applicable taxes unless otherwise stated.
5. SITE ACCESS & CONDITIONS
The client is responsible for ensuring safe and clear access to the work site. This includes removing personal property, vehicles, pets, and identifying all utilities through Alberta One-Call prior to commencement. Delays caused by lack of access or unidentified utilities may result in additional charges.
6. LIABILITY & INSURANCE
Origin Earthworks Ltd. carries comprehensive liability insurance and WCB coverage. Our liability is limited to the scope of work outlined in the agreement. We are not responsible for pre-existing conditions, acts of nature, or third-party damage outside our direct control.
7. CANCELLATION
Cancellations made more than 48 hours before scheduled work incur no charge. Cancellations within 48 hours may be subject to a cancellation fee to cover mobilization costs.
8. WARRANTY
We stand behind our work. Grading and drainage installations are warrantied against defects in workmanship for one year from completion date. This warranty does not cover damage from third parties, natural disasters, or homeowner modifications.
9. SMS TEXT MESSAGING TERMS
By providing your phone number on any of our forms, website, or in conversation with our team, you consent to receive SMS and MMS text messages from Origin Earthworks Ltd. at the number you provided. This includes messages related to:
- Estimate requests, quotes, and scheduling
- Project updates, status notifications, and service reminders
- Customer service and follow-up communications
- Promotional or marketing messages (only if you have explicitly opted in)
Message Frequency: Message frequency varies depending on your interaction with us. Typically, you may receive 1–10 messages per month related to active projects or inquiries. If you opt into marketing messages, frequency may increase.
Opt-Out: You may opt out of receiving SMS/MMS messages at any time by replying STOP to any message we send. Upon opting out, you will receive a single confirmation message. No further messages will be sent unless you re-subscribe.

Carrier Disclaimer: Message and data rates may apply. Origin Earthworks Ltd. is not responsible for any charges imposed by your mobile carrier for SMS or MMS messages. Delivery of messages is not guaranteed and may be delayed by your carrier.
Eligibility: You must be at least 18 years of age and the owner or authorized user of the phone number provided to consent to receive messages. You represent that you are authorized to consent to messages on behalf of any phone number you provide.
Carrier Liability: Origin Earthworks Ltd. is not liable for delayed or undelivered messages, carrier filtering, or any disruptions in service caused by your mobile carrier. We are not responsible for messages sent to numbers that have been reassigned to a different user without our knowledge.

10. FORCE MAJEURE
Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, labor strikes, government actions, or supply chain disruptions.
11. GOVERNING LAW
These terms are governed by the laws of the Province of Alberta and the laws of Canada applicable therein. Any disputes shall be resolved in the courts of the Province of Alberta.
12. CHANGES TO THESE TERMS
We may update these Terms & Conditions periodically. Changes will be posted on this page with an updated revision date. Continued use of our services or website after changes constitutes acceptance of the updated terms.
